Q. I purchased a house a few years ago and the title company failed to do a proper title search. There was a federal tax lien on the house from the previous owner, and it remained attached to what is now my property. The title company will only pay if the fed's come to collect. I am under the impression that this lien will have to be renewed after so many years and because I own this property, it will not reattach to this property. A Notice of Federal Tax Lien attaches to all property or rights to property owned by the taxpayer (in your case, I presume the seller) and expires 10 years from the date of assessment as stated on the actual document. If you got title insurance as part of the home purchase and want the lien released you are within your rights to demand that the title company pay to have it released immediatley; failure to do so is complete nonsense. They guaranteed clear title and have a contractual obligation to deliver it. If you have a mortgage on the property, I suggest you contact the lender and ask them to intervene for you AND them.
